Legal Tip:
When someone designs something for you—such as a website, a logo, even a building—you don’t automatically own the design.  The designer does.  Generally, to own works that others are making for you, you need a work-for-hire agreement in writing.  If the work has already been created for you, then get an assignment agreement in writing to secure your ownership rights.  For more info, see this.

Client Corner:
Therapy Studios:
Joe DiSanto, John Ramsay, Doobie White and Wren Waters (pictured from right to left) founded Therapy Studios in 2005.  Their award-winning operation handles a full range of post-production needs.  And their creative touch doesn’t stop there—they designed their hip new workspace (furnishing all of the interiors) and served as executive producers of Transcendant Man (2009), a documentary about inventor and futurist Ray Kurzweil.  For more info, see www.youneedtherapy.tv.

Legal Update, Business:
Health Care Changes May Affect Your Business:

Many provisions of the new health care reform law do not kick in until 2014, but some take effect immediately.  The law will enable small businesses to pool together to buy insurance and allow for certain tax credits.  Some businesses will have new insurance requirements for employees.  How will it affect you?  It may be complex, so, for more detailed information, see this

Legal Update, Copyright Law:
What's In Your Website?
A U.S. District Court recently decided that when a business goes live with a website, the contents of the website are considered “published” for copyright purposes.  Other courts may follow their lead.  Why is this important?  The date of publication starts a 3-month countdown for registering copyrights for the contents of the site.  If you miss this 3-month deadline, and someone infringes your work, you lose your right to recover statutory damages of up to $150,000 per work (though you can still make a claim based on actual damages).  For more information, see this article.
